Manifestation Determination Review (MDR) Best Practices
MDR for Special Education Students




At specific times, and for certain violations of the student code of conduct, IDEA’s discipline procedures require school systems to conduct what is known as a “manifestation determination review.” The purpose of this review is to determine whether or not the child's behavior that led to the disciplinary infraction is linked to his or her disability.  

However, this review is often a portion of a larger process, and as such, it is necessary to understand what steps and how to proceed in order to safeguard the student's right to a Free and Appropriate Public Education (FAPE).


Important Session Information:


The MDR process can be highly emotionally charged!  Attend this workshop to learn the myths and truths of MDR that will support efficient, effective and legally defensible practices.  We will review selected MDR due process hearings to highlight trends, discuss critical actions along the mandated timeline, and highlight alternative disciplinary practices to reduce the need for MDRs.  Useful documents will be provided to support your implementation of the legal mandates of manifestation determination.
